This Privacy Policy (“Privacy Policy”) addresses the privacy practices of Automotive VT, a New Jersey company (“AVT”), and the possible uses of the information collected, used, shared, and secured via  automotivevt.com (the “Website”) and other submissions by you, the user (“You” or “Your”), to AVT. This Privacy Policy applies to all AVT’s services offered on and in connection with the Website (“Services”). This Privacy Policy is incorporated into and should be read together with AVT’s Terms of Use.

By using the Website or Services, You acknowledge that AVT will collect, use, disclose, retain, and protect Personal Information as described in this Privacy Policy. If You do not agree with AVT’s practices described in this Privacy Policy, You should discontinue use of the Website and Services.

Modifications and Changes

AVT may modify this Privacy Policy from time to time. Except where a change is required to comply with applicable law, address an immediate security concern, or correct a non-material error, AVT will provide at least thirty (30) days’ prior notice of any material change to this Privacy Policy. Notice may be provided by posting the revised Privacy Policy on the Website, providing a notice through the Services, sending notice to the email address associated with Your account, or through another reasonable method. The revised Privacy Policy will identify its effective date and will apply prospectively from that date, except to the extent otherwise required by applicable law. Your continued use of the Website or Services following the effective date of a revised Privacy Policy constitutes Your acknowledgment of AVT’s privacy practices as described in the revised Privacy Policy.
 

Information Collected

AVT, through its Services, provides digital replicas, 3D models, and related images (“Images”). The Services are designed primarily to create Images of vehicles and are not intended principally for the collection or display of images of individuals. By uploading, submitting, or otherwise providing an Image to AVT, You represent and warrant that You own the Image or otherwise possess all rights, permissions, and authority necessary for AVT to collect, process, use, and display the Image in connection with the Services. If an Image depicts an identifiable individual, You further represent and warrant that You have obtained all legally required authorization or consent from that individual. If an Image depicts an individual who is under eighteen (18) years of age or otherwise under the applicable age of majority, You represent and warrant that You have obtained any legally required authorization or consent from that individual's parent or legal guardian before providing the Image to AVT.

YOU AGREE TO INDEMNIFY AND HOLD AVT HARMLESS FROM AND AGAINST ANY LAWSUIT BROUGHT RELATED TO AN IMAGE CREATED AND DISPLAYED USING THE SERVICES. 

As part of providing its Services, AVT collects the following information:

1. Personal Information

   “Personal Information” can include, but is not limited to, information telling us who You are. Examples of such information include Your name, phone number, email, physical address, business information, and possibly information related to certain support or Client service issues. Personal Information could also include the Images uploaded and submitted to AVT. 

2. Submission of User Generated Content

   AVT collects information that You voluntarily provide through the Website and Services, including Personal Information, Customer Content, Images, and other information or materials You submit (“User Generated Content”). AVT may host, process, reproduce, transmit, display, or share User Generated Content as reasonably necessary to provide, operate, support, maintain, or improve the Services, as directed or authorized by You, and as otherwise described in this Privacy Policy. AVT may also provide User Generated Content to third-party service providers acting on AVT’s behalf to the extent reasonably necessary for those providers to perform services for AVT. AVT will not disclose Personal Information contained within User Generated Content except as described in this Privacy Policy or otherwise permitted or required by applicable law. You should not provide User Generated Content that You do not have the legal authority to provide to AVT.

3. Collective Information

   We may collect general, non-personal, statistical information about the use of the Website and Services, such as how many visitors link to a specific page on the Website, how long they stay on that page, and which hyperlinks, if any, are clicked on. This information represents a generic overview of our users, including collective viewing habits, and allows us and other third-parties to modify information, promotions, and/or offers on services based on user traffic and behavior. We collect this information by using technologies like web beacons, which is further discussed below. We collect this information to help enhance the Website and Services and improve the visitor experience for You.

4. Third Party Information

   We may supplement information You provide to us with information from other sources. We use this information to help us maintain the accuracy of the information we collect, enable us to fulfill our services, target our communications so we can inform You of services and offers that may be of specific interest to You, and for internal business analysis or other business purposes consistent with our mission.

   Our site stores cookies and uses other web tracking tools. In using the Services, cookies may be stored on Your computer. AVT stores cookies to authenticate users after entering a user/password. AVT also stores cookies for unfinished orders to allow Users an opportunity to continue building it next time.

Information concerning a business or vehicle may be associated with Content or Output created through the Services to the extent reasonably necessary to provide and display the applicable Services.

Disclosures and Transfer of Information

AVT may disclose Personal Information to third parties only as described below, as otherwise disclosed to You at or before the time of collection, with Your authorization, or as permitted or required by applicable law. Instances where AVT may disclose Personal Information to third parties includes, but it not limited to the following conditions:

• AVT obtains Your permission to make the disclosure;
• The disclosure is necessary for the purpose of how the personal information was obtained;
• The disclosure is to financial service providers in order to fulfill and carry out the services requested by You;
• The disclosure is permitted by relevant law;
• The Personal Information to be disclosed is otherwise publicly available in accordance with the applicable law;
• The disclosure is reasonably related to the sale or other disposition of all or part of our business or assets;
• The disclosure is for AVT’s own marketing purposes, or for the marketing purposes of third-parties with Your authorization;
• The disclosure is combined with information collected from other companies and used to improve and personalize services, content, and advertising from us or third-parties;
• The party to whom the disclosure is made controls, is controlled by, or is under common control with AVT;
• The disclosure is in AVT’s sole and exclusive discretion necessary for the establishment or maintenance of legal claims or legal compliance, to satisfy any law, regulation, subpoena, or government request, or in connection with litigation;
• The disclosure is in AVT’s sole and exclusive discretion about users who AVT believes are engaged in illegal activities or are otherwise in violation of the AVT Terms of Use and other agreements, even without a subpoena, warrant, or court order; or
• The disclosure is to outside businesses to perform certain services for us, such as maintaining our Website and Services, processing orders and delivering products and services, sending postal mail, processing claims for lost or stolen certificates, providing marketing assistance, confirming Your identity for review integrity, and data analysis (“Administrative Service Providers”), including data analysis.

Prior to sharing Your Personal Information with others, agreements are made between AVT and these outside parties to whom we are transferring data in order to provide for the allowable use and security of the transferred information in accordance with this Privacy Policy and any applicable law. If AVT becomes aware any such outside party is improperly using or disclosing Personal Information, we will notify the outside party and request that party take reasonable steps to cease such use or disclosure.

Accessing Your Information 

You can edit your profile information at any time. In order to unsubscribe, you will need to request that your account be closed through AVT messaging. Once an account is closed, AVT may store your information as required by state or federal law. We keep all transactions for records, invoices, visual content, payment history, contractual obligations, and so forth.

In addition, You can inquire as to the following: whether we are keeping information about You; how Your information is being used; request that we update or correct Your information; or ask to opt-out of our collection and use of certain information by clicking HERE and sending AVT a message through our messaging process or by writing us at the address listed at the bottom of this Privacy Policy, specifying the nature and scope of Your request. If You choose to opt-out of the collection and use of certain information, You understand that some services may no longer be available to You, potentially requiring the cancellation of Your account with AVT. Please note that we may require proof of Your identity before providing You with the requested information.

Accessing Your Information 

You agree that AVT may display advertisements in connection with your use of the Service. The Service may display advertisements, sponsored content, or promotions provided by third parties (“Third-Party Ads”). These Third-Party Ads may be targeted based on your activity on the Service or other information. AVT does not control, endorse, or assume responsibility for any Third-Party Ads, including the accuracy, legality, or content of such advertisements, or the products and services offered by third parties. Any interactions, transactions, or dealings you have with advertisers or third parties are solely between you and such third-party. We are not responsible or liable for any loss or damage of any kind incurred as a result of any such dealings or as a result of the presence of Third-Party Ads on the Service. If Third-Party Ads are available, no users is entitled to any profit or other compensation from those ads. 

Third-Party Ads may contain links to external websites that are not owned or controlled by us. If you click on an ad and leave the AVT website or services, AVT is not responsible for the content, data collection practices, privacy practices, and/or security of those third-party sites or services. You agree to indemnify and hold AVT harmless from any and all claims or actions arising from the use of any third-party sites or services, even if you discovered those sites and services through advertisements on the AVT website. 

Data Security, Integrity, and Access

The Personal Information You provide and AVT collects is stored within databases controlled by AVT directly or through its Administrative Service Providers. As AVT deems necessary and is required by the applicable law, AVT uses security measures appropriate for the sensitivity of the Personal Information and consistent with industry standards, i.e., physical, organizational, and technological protections, such as but not limited to firewalls and encryption technology to protect Your Personal Information and also password information. The use of these safeguards does not constitute a representation or guarantee that AVT’s systems, or information transmitted over the Internet, will be immune from unauthorized access, loss, misuse, or other security incidents.

Nevertheless, no security system is impenetrable. AVT cannot guarantee the security of its systems. Moreover, it cannot guarantee any information You supply will not be intercepted while being transmitted to AVT over the Internet.

Personal Information may only be accessed by persons within AVT, third-party service providers who require such access to provide You with the Services indicated above, or any other party You have provided us with authorization to share such information. We retain Personal Information collected by us only if reasonably necessary to fulfill the purposes for which it was collected or to otherwise meet any legal requirements.

Your information may be transferred to, and maintained on, computers located outside of Your state, province/territory, or country where the privacy laws may not be as protective as those where You live. If You are located outside of the United States and choose to provide information to us, please be aware we transfer Personal Information to the United States where it is processed and stored. As a result, this information may be subject to access requests from governments, courts, law enforcement officials, and national security authorities in the United States according to its laws and/or regulations. Although we do not share Your Personal Information with these third-party websites unless You have authorized us to do so, these third-party websites may be able to link certain non-personally identifiable information we transfer to it with Personal Information the websites previously collected from You. In addition, AVT informs You that anytime You click on links taking You to third-party websites, You will be subject to the third-parties’ privacy policies. While we support the protection of our Client’s privacy on the Internet, AVT  expressly disclaims any and all liability for the actions of third-parties, including but not limited to the use and/or disclosure of Personal Information by third-parties. This means AVT is not responsible for data collection, data storage, data security, or data privacy practices of any Third-Party website or service provider despite whether You linked to that website through AVT. AVT’s inclusion of such links does not by itself imply any endorsement of the content on those websites or of its owners or operators, except as disclosed on the Website and Services. Any information submitted by You directly to these third-parties is subject to the third-party’s privacy policy.

Children’s Privacy

The Website and Services are not directed to individuals under eighteen (18) years of age, or under the applicable age of majority in their jurisdiction, and such individuals may not independently establish or maintain an AVT account. The fact that an individual under the applicable age of majority may appear incidentally in an Image does not authorize that individual to use the Website or Services. AVT’s Services are primarily designed to process Images of vehicles and are not intended principally to collect Images of individuals. If You nevertheless provide AVT with an Image depicting a minor, You represent and warrant that You have obtained all consent or authorization required by applicable law from the minor’s parent or legal guardian. AVT may process such an Image only in connection with the purposes described in this Privacy Policy and the provision of the Services.

AVT is also not intended to contain the images of any individuals, including minors. AVT relies upon parents or guardians to determine if the Website and Services are appropriate for viewing, access, or participation by such individuals under the age of majority. AVT does receive images of children for the purposes of performing the Services. If You are uploading or providing AVT with the image of a child, it is Your responsibility to obtain the appropriate consent from the parent or guardian of that child. By using the Services, You specifically warrant, represent, and agree that You have obtained any appropriate consent from any individual in any image. You agree to indemnify and hold AVT harmless from and against any action brought against AVT for any image You provide to AVT, including those images of any minor.

California Residents’ Privacy Rights

This Privacy Policy describes how we may share Your information for marketing purposes. If You are a California resident, then California law may provide You with additional rights as to our use of Your Personal Information. Also, California residents may request a list of any Personal Information provided to third-parties in the preceding year for direct-marketing purposes. AVT is not intended for use outside of North America. This Privacy Policy describes how we may share Your information for marketing purposes. Non-residents of the United States may request a list of any Personal Information provided to third-parties in the preceding year for direct marketing purposes. Governing Law

This Privacy Policy shall be governed by and construed in accordance with the laws of the State of New Jersey without giving effect to any choice or conflict of law provision or rule causing the application of the laws of any jurisdiction other than the State of New Jersey.
