This Privacy Policy applies to all AVT’s services offered on and in connection with the Website (“Services”). This Privacy Policy is incorporated in the Terms of Use.

AVT may in its sole discretion modify or change this Privacy Policy at any time, effective upon posting the modified or changed Terms of Use on the Website and by providing You with notice of such modification or change through a pop-up when you access the Services, and/or notify you by some other means at the sole discretion of AVT. AVT is not obligated to provide more than one form of notice, which can be just a notification on the site. Any such changes will not apply to any claim brought prior to the date whereupon AVT posted the revised Privacy Policy incorporating such modifications or changes. AVT may modify, update, suspend, or discontinue the Website and Services, in whole or in part, at AVT’s sole and exclusive discretion for any or no reason, at any time, and with or without notice.

Information Collected

AVT collects information about You in various ways, e.g., by Your voluntary submissions, postings and participation in services provided via the Website and Services, from third-parties with Your consent, and through cookie and other tracking technology. AVT, through its Services provides digital replicas/3D models (the “Images”). By using the Services and creating the Images, You certify and agree that any vehicle shown in the Image is owned by You and/or that You have the legal right and/or authority to take and display the Image. AVT is not intended to include images of people. In the event the Image contains a picture of an individual or group of individuals, You agree that the individual or group of individuals has/have agreed and consented to the collection and display of the Image by You. You hereby agree and warrant that any individual(s) captured as part of an Image is eighteen (18) years of age, and you have their express consent to the collection and display of the Image.

YOU AGREE TO INDEMNIFY AND HOLD AVT HARMLESS FROM AND AGAINST ANY LAWSUIT BROUGHT RELATED TO AN IMAGE CREATED AND DISPLAYED USING THE SERVICES.

As part of providing its Services, AVT collects the following information:

1. Personal Information

“Personal Information” can include, but is not limited to, information telling us who You are. Examples of such information include Your name, phone number, email, physical address, business information, and possibly information related to certain support or customer service issues. Personal Information could also include the Images uploaded and submitted to AVT.

2. Submission of User Generated Content

We collect information that You voluntarily provide as part of our Website and Services, including Your Personal Information and any other information You submit through the Website and Services (“User Generated Content”). AVT may, in its sole discretion, share Your User Generated Content with other users. If You wish not to have certain information shared with others, You should not submit User Generated Content, nor should You submit User Generated Content containing information or Personal Information You do not want shared in this manner. Once You have submitted User Generated Content, we reserve the right to publish it to others.

3. Collective Information

We may collect general, non-personal, statistical information about the use of the Website and Services, such as how many visitors link to a specific page on the Website, how long they stay on that page, and which hyperlinks, if any, are clicked on. This information represents a generic overview of our users, including collective viewing habits, and allows us and other third-parties to modify information, promotions, and/or offers on services based on user traffic and behavior. Once an account is closed, AVT may store your information as required by state or federal law. We keep all transactions for records, invoices, visual content, payment history, contractual obligations, and so forth.

The Personal Information You provide and AVT collects is stored within databases controlled by AVT directly or through its Administrative Service Providers. As AVT deems necessary and is required by the applicable law, AVT uses security measures appropriate for the sensitivity of the Personal Information and consistent with industry standards, i.e., physical, organizational, and technological protections, such as but not limited to firewalls and encryption technology to protect Your Personal Information and also password information.

Children’s Privacy

AVT does not intend the Website and Services to be used by individuals under the age of majority within the jurisdiction where they reside without the supervision of a parent or guardian of majority age. Furthermore, AVT is not intended to contain the images of any individuals, including minors. AVT relies upon parents or guardians to determine if the Website and Services are appropriate for viewing, access, or participation by such individuals under the age of majority. If an individual under the age of majority uses the Website and Services, this individual may only use the Website and Services under the supervision of a parent or guardian of majority age.

AVT does receive images of children for the purposes of performing the Services. If You are uploading or providing AVT with the image of a child, it is Your responsibility to obtain the appropriate consent from the parent or guardian of that child. By using the Services, You specifically warrant, represent, and agree that You have obtained any appropriate consent from any individual in any image. Governing Law
